1. Agreement to Terms
By creating an account or using SilenceAlarm ("the Service"), you agree to these Terms of Service ("Terms"). If you do not accept them, you may not use or access the Service.
2. Description of the Service
SilenceAlarm is an online platform that continuously monitors live audio streams and provides:
- Real-time silence and audio-signal detection
- Stream availability and connection checks
- Instant alerts by email (and optionally SMS/Webhooks in Pro plans)
- Historical analytics and uptime reports
- EBU R128 loudness measurement for professional users
The Service is intended for authorized monitoring of your own or permitted third-party streams.
3. Stream Monitoring Responsibility
When you add a stream URL to SilenceAlarm, you confirm and guarantee that:
- You are lawfully entitled to monitor that stream.
- All required permissions from the content owner or operator have been obtained.
- You assume full responsibility for any monitoring activity performed through your account.
- You will not attempt to analyze or access streams without authorization.
If SilenceAlarm becomes aware of possible misuse or receives a complaint from a content owner, we may temporarily or permanently disable monitoring for the affected stream.
4. Account Registration
To use the Service, you must:
- Provide accurate and complete registration details.
- Keep your login credentials confidential and secure.
- Be at least 13 years old or meet the legal age of majority in your jurisdiction.
- Comply with all local and international laws applicable to your use of the Service.
You are solely responsible for any activity occurring under your account.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, infringing, or unauthorized purposes.
- Attempt to interfere with, overload, or disrupt our systems.
- Access data or systems you are not entitled to access.
- Upload or distribute malicious software or harmful code.
- Resell, redistribute, or white-label the Service without written permission.
We reserve the right to limit, suspend, or terminate accounts violating this section.
6. Plans, Billing, and Payments
6.1 Free Plan
The Free plan provides limited monitoring functionality and reduced data retention as shown on our pricing page.
6.2 Pro Plan
Pro plans are billed on a monthly or yearly basis. You can cancel any time before the next billing cycle; refunds are handled per Section 6.4.
6.3 Automatic Renewal
Paid subscriptions renew automatically unless canceled before renewal. Any pricing adjustments will be announced with at least 30 days' notice.
6.4 Refunds
Refunds are assessed individually. Refunds are not granted for:
- Accounts suspended or terminated due to misuse or policy violations
- Partial billing cycles or unused subscription time
- Missed alerts or limited availability due to maintenance or outages
6.5 Payment Processing
All payments are securely handled by approved third-party processors. By subscribing, you authorize SilenceAlarm to charge your selected payment method for recurring fees.
7. Account Suspension and Deactivation
7.1 User-Initiated Deletion
You may close your account at any time via your dashboard or by contacting support.
7.2 Inactivity
Free accounts with no sign-ins for 60 consecutive days may be deactivated or deleted to free up resources.
7.3 Offline or Failing Streams
Streams that remain continuously offline or failing for over 30 days may be automatically removed from active monitoring to maintain service efficiency.
7.4 Abuse or Misuse
We may suspend or terminate accounts immediately—without prior notice—if we detect:
- Excessive or abusive API usage
- Unauthorized stream monitoring
- Fraudulent behavior, chargebacks, or payment disputes
Termination due to abuse does not entitle you to a refund.
8. Service Reliability
We aim to maintain high availability, but we cannot guarantee the Service will be uninterrupted, error-free, or immune to external failures. Temporary interruptions may occur due to maintenance, updates, or network issues.
9. Intellectual Property
All software, design, and documentation related to SilenceAlarm are the exclusive property of SilenceAlarm and protected by international copyright and trademark laws.
You retain ownership of your uploaded or submitted content but grant SilenceAlarm a limited license to process and store it solely for the operation of the Service.
10. Privacy and Data Protection
Your use of SilenceAlarm is subject to our Privacy Policy, which explains how we handle, store, and protect your personal data.
11. Limitation of Liability
To the fullest extent permitted by law, SilenceAlarm and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages—including loss of profits, data, or goodwill—resulting from the use or inability to use the Service.
12. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. SilenceAlarm makes no express or implied warranties regarding reliability, accuracy, or fitness for a particular purpose. Use the Service at your own risk.
13. Modifications to These Terms
We may revise these Terms periodically. Significant updates will be posted on this page with a revised "Last updated" date. Continuing to use the Service after changes take effect constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, excluding its conflict-of-law rules.
